
Order in Council 1449/2024
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas The Niagara Parks Commission is the owner of the lands, having the description set out in Schedule “A”, attached hereto (the “Lands”);
And whereas The Niagara Parks Commission, as landlord, wishes to lease the Lands to Toronto Power Hotel Inc., as tenant, for a term of 75 years, with one option for the tenant to extend the term for an additional 24 years, for the purpose of redeveloping, operating and maintaining the Toronto Power Generating Station and constructing, operating and maintaining a parking structure across the street from the Toronto Power Generating Station, in Niagara Falls, Ontario;
And whereas subsection 7(1) of the Niagara Parks Act authorizes The Niagara Parks Commission, subject to the approval of the Lieutenant Governor in Council, to sell or otherwise dispose of any land or any interest in land;
Now therefore, pursuant to subsection 7(1) of the Niagara Parks Act, approval is hereby given to The Niagara Parks Commission to:
- lease the Lands to Toronto Power Hotel Inc. for a term of 75 years, with one option for the tenant to extend the term for an additional 24 years, for the purpose of redeveloping, operating and maintaining the Toronto Power Generating Station and constructing, operating and maintaining a parking structure across the street from the Toronto Power Generating Station, in Niagara Falls, Ontario; and
- execute such documents as may be necessary for that purpose.
