Order in Council 1484/2025

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the MPPs Pension Act, 1996 is amended effective January 1, 2026, to require the Members of Provincial Parliament (MPPs) to be members of the Public Service Pension Plan (PSPP) which is Schedule 1 to the Public Service Pension Act, 1989, as amended (PSPA);

And whereas under the MPPs Pension Act, 1996, as amended, the Lieutenant Governor in Council may, by order, establish a supplemental pension plan for members of the Public Service Pension Plan who are members of the Assembly (the “MPP supplemental pension plan”) subject to certain conditions;

And whereas the Public Service Pension Plan Retirement Compensation Arrangement (PSPP RCA) was established under Subsection 6.0.1(1) of the PSPA as a supplemental pension plan for certain classes of members of the PSPP and is set out as Schedule 1 to Order in Council 1298/2021;

And whereas it is necessary and advisable to revise the existing PSPP RCA made under Order in Council 1298/2021 to address the establishment of the new MPP supplemental pension plan;

Now therefore,

1. Pursuant to Section 54 of the MPPs Pension Act, 1996, the MPP supplemental pension plan as set out in Schedule 2 to this Order is established; and
2. Pursuant to Subsection 6.0.1(1) of the PSPA, the Public Service Pension Plan Retirement Compensation Arrangement made under Order in Council 1298/2021 is amended as follows:
   1. by revoking Schedule 1 thereof and substituting Schedule 1 attached to this Order; and
   2. by adding the MPP supplemental pension plan as set out in Schedule 2 to this Order as Schedule 2 to Order in Council 1298/2021.

And pursuant to Subsection 10(1) of the MPP Pensions and Compensation Act, 2025 and Section 10 of the Legislation Act, 2006, this Order is effective as of January 1, 2026.
