Order in Council 1608/2025

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Transit Oriented Communities ("TOC") program seeks to advance provincial priorities by connecting residential and commercial development to transit, increasing housing supply, reducing traffic congestion, and stimulating the economy through major infrastructure projects and maximizing ridership on new and existing subways, light rail projects and GO Transit rail lines, collectively “priority transit projects” as defined in section 1 of the Transit Oriented Communities Act, 2020, S.O. 2011, c. 18, Sched. 20 ("TOCA").

And whereas the Minister of Infrastructure is responsible for functions, responsibilities and programs, in respect of TOC under TOCA;

And whereas Ontario Infrastructure and Lands Corporation ("OILC") has been delegated the Minister of Infrastructure’s authorities to deal with corporations for the purposes of investing assets in, supporting or developing TOC projects, subject to certain conditions, by Delegation of Authority to OILC under TOCA as permitted under section 4(4) of TOCA;

And whereas pursuant to subsection 4(1) of TOCA the Minister of Infrastructure or OILC as a delegate of the Minister requires approval of the Lieutenant Governor in Council to deal with corporations for the purpose of supporting or developing TOC projects;

And whereas the Minister of Infrastructure wishes to enter into agreements with 590 Argus Developments Inc., 590 Argus LP, 166 South Service Inc., 166 South Service LP, Cross Realty Incorporated, Cross Realty LP, Argus Cross Inc., DW Argus Cross LP (the "Companies" or “Limited Partnerships”, as the case may be) for the purpose of developing the Oakville TOC project intended to support ridership on the Lakeshore West GO Transit railway line (the "Project");

Now therefore, pursuant to subsection 4(1) of TOCA, the Minister of Infrastructure and OILC are authorized to enter into agreements with the Companies and Limited Partnerships and any assignees or transferees of the Companies and the Limited Partnerships for the purpose of developing the Project.
