On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Pursuant to subsection 6 (1) of the Public Service Pension Act, the Public Service Pension Plan set out in Schedule 1 to the Public Service Pension Act, 1989, as amended, is further amended effective on October 1, 2024, as follows:

Section 26 of the Public Service Pension Plan is amended by adding as subsections (3.5) and (3.6) the following:

Re-Employment / Engagement Related to Collective Bargaining Labour Disruptions

(3.5) Despite subsection (1), where a former member who is receiving a pension is re-employed or engaged by the Crown or another employer because of a collective bargaining labour disruption and for the purposes of ensuring the continuity of public services, and where the Minister directs the Board in writing that this provision shall apply for a period of time in respect of such labour disruption, the pension of the former member shall not be reduced in respect of the period of that re-employment or engagement.

(3.6) The Board may require the employer and the former member to provide such information as it deems necessary for the purposes of complying with subsection (3.5).
