
Order in Council 555/2025
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas certain Orders in Council made under the Financial Administration Act and various Ontario Loan Acts authorize borrowing by the issue and sale of treasury bills and unsecured short-term promissory notes and by way of loan or by the issue and sale of securities of Ontario on the credit of the Consolidated Revenue Fund of Ontario;
And whereas certain Orders in Council made under section 21 of the Financial Administration Act authorize borrowing for the purpose of the payment, renewal, repayment or replacement of various loans and securities;
And whereas certain Orders in Council made under the Financial Administration Act and section 68 of the Electricity Act, 1998, section 21 of the Capital Investment Plan Act, 1993, or subsection 23(1) of the Ontario Infrastructure and Lands Corporation Act, 2011 authorize borrowing by way of loan or the issue and sale of securities of Ontario;
And whereas certain Orders in Council made under subsection 23(2) of the Ontario Infrastructure and Lands Corporation Act, 2011 authorize the Minister of Finance to purchase securities of or make loans to Ontario Infrastructure and Lands Corporation;
And whereas Order in Council 771/2002 authorizes certain agreements to be entered into on behalf of Ontario and the Ontario Financing Authority with respect to the establishment, governance, funding and management of segregated funds for the funding of the costs of decommissioning and the management and disposal of nuclear waste (including used fuel) produced by certain stations and other facilities owned or operated by Ontario Power Generation Inc. and certain of its subsidiaries, as set out in the Order in Council;
And whereas it is desirable to amend the aforementioned existing Orders in Council to update the authorized signing officers and to ensure continuity of such delegations despite position title changes;
Therefore:
Orders made under the Financial Administration Act and Ontario Loan Acts
- Amendments are made to the paragraph inserted between paragraphs 2 and 3 and paragraph 4(c) of Orders in Council 318/92, 926/92, 3594/92 and 1358/93, each as amended, the paragraph inserted between paragraphs 2 and 3 and paragraph 4(iii) of Orders in Council 79/92 and 2096/93, each as amended, paragraphs 3 and 4(c) of Orders in Council 865/2023, as amended, paragraphs 3 and 5(c) of Orders in Council 1417/2008, 1043/2009, 1048/2010, 460/2015, 1167/2018 and 717/2020, each as amended, paragraphs 3 and 5(iii) of Orders in Council 1044/2009, 600/2012, 966/2013 and 459/2015, each as amended, paragraphs 4 and 6(c) of Order in Council 831/2008, as amended, and paragraphs 5 and 7(c) of Order in Council 1703/95, as amended, in each case by deleting the words “Executive Director and Chief Investment Officer, Capital Markets Division” and substituting with the words “Chief Treasury and Investment Officer”.
- Amendments are made to paragraph 6 of Orders in Council 1417/2008, 1043/2009, 1044/2009, 1048/2010, 600/2012, 966/2013, 459/2015, 460/2015, 1167/2018 and 717/2020, each as amended, and paragraph 7 of Orders in Council 831/2008 and 865/2023, each as amended, by adding the sentence “If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
- Amendments are made to Orders in Council 79/92, 926/92, and 3594/92, each as amended, by adding a new paragraph 6 reading as follows:
“6. If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.” - Amendments are made to Orders in Council 318/92 and 1358/93, each as amended, by adding a new paragraph 7 reading as follows:
“7. If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.” - Amendments are made to Order in Council 2096/93, as amended, by adding a new paragraph 8 reading as follows:
“8. If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.” - Amendments are made to Order in Council 1703/95, as amended, by adding a new paragraph 9 reading as follows:
“9. If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
Orders made under section 21 of the Financial Administration Act
- Amendments are made to paragraphs 4 and 5(c) of Order in Council 620/2024 by deleting the words “Executive Director and Chief Investment Officer, Capital Markets Division” and substituting with the words “Chief Treasury and Investment Officer”.
- Amendments are made to paragraph 8 of Orders in Council 620/2024 and 1696/2024 by adding the sentence “If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
Orders relating to the Electricity Act, 1998
- Amendments are made to paragraphs 3, 5(c) and 6 of Orders in Council 561/2000 and 1168/2002, each as amended, paragraphs 3, 4(iii) and 7 of Order in Council 967/2013, as amended, and paragraphs 3, 4(c) and 7 of Order in Council 783/2023, as amended, in each case by deleting the words “Executive Director and Chief Investment Officer, Capital Markets Division” and substituting with the words “Chief Treasury and Investment Officer”.
- Amendments are made to paragraph 6 of Orders in Council 561/2000 and 1168/2002, each as amended, and paragraph 7 of Orders in Council 967/2013 and 783/2023, each as amended, each as amended, in each case by:
- deleting the word “and” after “any Director, Capital Markets Division”; and adding the word “and” before “any Senior Manager, Capital Markets Division”.
- Amendments are made to Order in Council 514/99 by:
- Deleting paragraph 3(b) and substituting:
“(b) the Chief Executive Officer, the Chief Treasury and Investment Officer, the Chief Financial Officer, any Director, Capital Markets Division, any Senior Manager, Capital Markets Division, and the Director, Treasury and Capital Markets Operations, Finance and Treasury Division, all of the Ontario Financing Authority;” - Adding a new paragraph 4 reading as follows:
“4. If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
- Deleting paragraph 3(b) and substituting:
- Amendments are made to paragraph 7 of Orders in Council 561/2000 and 1168/2002, each as amended, and paragraph 8 of Orders in Council 967/2013 and 783/2023, each as amended, by adding the sentence “If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
Orders relating to the Capital Investment Plan Act, 1993
- Amendments are made to paragraphs 3 and 4(iii) of Orders in Council 678/2009 and 975/2009, each as amended, in each case by deleting the words “Executive Director and Chief Investment Officer, Capital Markets Division” and substituting with the words “Chief Treasury and Investment Officer”.
- Amendments are made to paragraph 6 of Order in Council 678/2009, as amended, and paragraph 7 of Order in Council 975/2009, as amended, by adding the sentence “If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
Orders relating to the Ontario Infrastructure and Lands Corporation Act, 2011
- Amendments are made to paragraph 2 of Orders in Council 631/2014, 1524/2014, 1566/2016, 1169/2018, 880/2022 and 881/2022, each as amended, and paragraphs 3, 4(iii), and 7 of Orders in Council 1229/2013 and 632/2014, each as amended, in each case by deleting the words “Executive Director and Chief Investment Officer, Capital Markets Division” and substituting with the words “Chief Treasury and Investment Officer”.
- Amendments are made to paragraph 2 of Orders in Council 631/2014, 1524/2014, 1566/2016, 1169/2018, 880/2022 and 881/2022, each as amended, and paragraphs 3 and 7 of Orders in Council 1229/2013 and 632/2014, each as amended, in each case by:
- deleting the word “and” after “any Director, Capital Markets Division”; and
- adding the word “and” before “any Senior Manager, Capital Markets Division”.
- Amendments are made to paragraph 3 of Orders in Council 631/2014, 1524/2014, 1566/2016, 1169/2018, 880/2022 and 881/2022, each as amended, and paragraph 8 of Orders in Council 1229/2013 and 632/2014, each as amended, by adding the sentence “If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
Order relating to the Ontario Nuclear Funds Agreement
- An amendment is made to paragraph 2(b) of Order in Council 771/2002, as amended, by deleting the words “Executive Director and Chief Investment Officer, Capital Markets Division” and substituting with the words “Chief Treasury and Investment Officer”.
- An amendment is made to paragraph 2 of Order in Council 771/2002, as amended, by adding the sentence “If the title of the position to which powers and duties have been delegated changes, the delegation made in this Order continues to be in effect on condition that the delegated powers and duties continue to be within the scope of the position.”
And that this Order in Council is effective on the date this Order in Council is made.
