
Order in Council 589/2025
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas the Minister of Infrastructure is leading the Province’s Transit-Oriented Communities Program that aims to build vibrant, mixed-use communities that will bring more housing (including affordable housing options), jobs, retail, public amenities and entertainment within a short distance of transit stations;
And whereas section 47 of the Planning Act provides the Minister of Municipal Affairs and Housing with the authority to make, administer and amend or revoke Minister’s zoning orders exercising the powers of a local municipality under sections 34, 38 and 39 of that Act;
And whereas it is considered desirable, given the Ministry of Infrastructure’s role as a central agency in the delivery of infrastructure programs, that the Minister of Infrastructure be able to make, administer and amend or revoke Minister’s zoning orders in respect of transit-oriented community land, including Minister’s zoning orders made before the date of this Order in Council, while not derogating from the authority of the Minister of Municipal Affairs and Housing to make, administer and amend or revoke Minister’s zoning orders applicable to any land in Ontario, even while Minister’s zoning orders for purposes related to transit-oriented land are made by the Minister of Infrastructure;
And whereas clause 8 (1) (a) of the Executive Council Act provides that the authority of the Lieutenant Governor under the Act includes authority, by Order in Council, to assign responsibility for the administration of an Act or a part of an Act to a minister of the Crown;
And whereas clause 8 (1) (e) of the Executive Council Act provides that the authority of the Lieutenant Governor under the Act includes authority, by Order in Council, to direct that two or more ministers share responsibility for the administration of an Act or a part of an Act;
And whereas clause 8 (1) (g) of the Executive Council Act provides that the authority of the Lieutenant Governor under that Act includes authority, by Order in Council, to direct that two or more ministers share a power, duty, function or responsibility under an Act or part of an Act;
Now therefore, pursuant to clause 8 (1) (a) and clause 8 (1) (e) of the Executive Council Act, and despite any provision of a statute or Order in Council, the Minister of Infrastructure shall share responsibility for the administration of section 47 of the Planning Act in respect of transit-oriented community land designated under subsection 2 (1) of the Transit-Oriented Communities Act, 2020 with the Minister of Municipal Affairs and Housing.
Further, pursuant to clause 8 (1) (g) of the Executive Council Act, and despite any provision of a statute or Order in Council, the Minister of Infrastructure may exercise the powers and perform the duties, functions and responsibilities of the Minister of Municipal Affairs and Housing under section 47 of the Planning Act in respect of transit-oriented community land designated under subsection 2 (1) of the Transit-Oriented Communities Act, 2020.
Further, Order in Council O.C. 440/2025 dated April 17, 2025 and Order in Council O.C. 1203/2022 dated August 29, 2022, are hereby amended and shall be interpreted accordingly.
