
Order in Council 590/2025
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas the Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Rama Police Service, Treaty Three Police Service, Tyendinaga Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service are First Nation police services in Ontario;
And whereas the Rama Police Service has requested to be designated as a participating employer in the Public Service Pension Plan, set out in Schedule 1, as amended, to the Public Service Pension Act, 1989 (PSPP) and in the Retirement Compensation Arrangement established under Order in Council 1298/2021, as may be amended from time to time (RCA), with respect to its officers and civilian employees;
And whereas the Tyendinaga Police Service has requested to be designated as a participating employer in the PSPP and in the RCA with respect to its officers and civilian employees;
And whereas the Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service are existing participating employers in the PSPP and in the RCA with respect to officers under their employment and now wish to also include their civilian employees as participating in the PSPP and in the RCA;
And whereas the Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service are existing participating employers in the PSPP and in the RCA with respect to officers under their employment, both full-time and fixed-term officers are currently required to join the PSPP;
And whereas on and after July 1, 2025, the Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service full-time officers will be required to join the PSPP but fixed-term officers will be entitled but not required to join the PSPP;
And whereas the Lieutenant Governor in Council considers it reasonable and appropriate for these First Nation Police Services to join as participating employers in the PSPP and in the RCA and for eligible employees of the First Nation Police Services to join the PSPP and the RCA;
And whereas members of the PSPP whose pension benefits under the PSPP exceed the maximum pension benefits permitted under the Income Tax Act (Canada) in respect of registered pension plans also participate in the RCA;
Now therefore, pursuant to:
- paragraph 2 of subsection 2(1) of the PSPP, all permanent full-time and permanent part-time employees of Rama Police Service are designated as a class of employees who are required to become members of the PSPP, in respect of service with Rama Police Service on and after July 1, 2025;
- subparagraph 1(b) of subsection 2(2) of the PSPP, all fixed-term full-time and fixed-term part-time employees of Rama Police Service are designated as a class of employees who are entitled but not required to become members of the PSPP, in respect of service with Rama Police Service on and after July 1, 2025, and shall, upon filing a written election with the Ontario Pension Board, become members of the PSPP;
- paragraph 2 of subsection 2(1) of the PSPP, all permanent full-time and permanent part-time employees of Tyendinaga Police Service are designated as a class of employees who are required to become members of the PSPP, in respect of service with Tyendinaga Police Service on and after July 1, 2025;
- subparagraph 1(b) of subsection 2(2) of the PSPP, all fixed-term full-time and fixed-term part-time employees of Tyendinaga Police Service are designated as a class of employees who are entitled but not required to become members of the PSPP, in respect of service with Tyendinaga Police Service on and after July 1, 2025, and shall, upon filing a written election with the Ontario Pension Board, become members of the PSPP;
- paragraph 2 of subsection 2(1) of the PSPP, all permanent full-time and permanent part-time employees of Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service are designated as a class of employees who are required to become members of the PSPP, in respect of service with Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service, respectively, on and after July 1, 2025; and
- subparagraph 1(b) of subsection 2(2) of the PSPP, all fixed-term full-time and fixed-term part-time employees of Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service are designated as a class of employees who are entitled but not required to become members of the PSPP, in respect of service with Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service, respectively, on and after July 1 2025, and shall, upon filing a written election with the Ontario Pension Board, become members of the PSPP;
And further that Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Treaty Three Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service shall continue to be employers under the PSPP and the RCA whose employees shall participate in the PSPP and in the RCA in accordance with the designations set out in this Order;
And further that effective July 1, 2025, Rama Police Service and Tyendinaga Police Service shall be employers under the PSPP and the RCA for the purpose of the employees designated in this Order in accordance with the designations set out in this Order;
And further that as designated by the Minister, civilian employees of the Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Rama Police Service, Treaty Three Police Service, Tyendinaga Police Service, UCCM Anishinaabe Police Service, Wikwemikong Tribal Police Service and of the employers governed by the Ontario First Nations Policing Agreement (OFNPA) are referred to in the PSPP as Non-OPP Civilians;
And further that as designated by the Minister, officers of the Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Rama Police Service, Treaty Three Police Service, Tyendinaga Police Service, UCCM Anishinaabe Police Service, Wikwemikong Tribal Police Service and of the employers governed by the OFNPA are referred to in the PSPP as Non-OPP Constables;
And further that the pursuant to subsection 6(1) of the Public Service Pension Act, R.S.O. 1990, c. P. 48, the PSPP is amended as set out in Schedule 1 to this Order.
