Schedule 1

Section 1 definition of “average annual salary” is amended by replacing paragraph (a) with the following, and by adding paragraphs (e), (f), (g), (h), (i) and (j) below:

  1. for a member who is neither
    1. represented by the Ontario Provincial Police Association,
    2. represented by the Commissioned Officers’ Association,
    3. the Commissioner of the Ontario Provincial Police,
    4. a police officer with the rank of deputy commissioner of the Ontario Provincial Police,
    5. a Non-OPP Constable, nor
    6. a Non-OPP Civilian,

the average of the member’s annual salary rate in each month of the period of sixty consecutive months of current or prior membership;

(e) for a member who is a Non-OPP Constable, or a member who is a Non-OPP Civilian, who terminated from the Plan before January 29, 2020, the average of the member's annual salary rate in each month of the period of sixty consecutive months of current or prior membership;

(f) for a member who is a Non-OPP Constable on January 29, 2020, who either:

i. commenced pension payments immediately after ceasing active service; or

ii. died,

on or after January 29, 2020, the average of the member’s annual salary rate in each month of the period of thirty-six consecutive months of current or prior membership;

(g) for a member who is a Non-OPP Civilian on January 29, 2020, who either:

i. commenced pension payments immediately after ceasing active service: or

ii. died,

on or after January 29, 2020, the average of the member’s annual salary rate in each month of the period offorty-eight consecutive months of current or prior membership;

(h) for a member who is a Non-OPP Constable, or for a member who is a Non-OPP Civilian, who terminated from the Plan but does not meet the requirements of subsection (f) or subsection (g) set out immediately above, during the period beginning on January 29, 2020 and ending on June 30, 2025, the average of the member’s annual salary rate in each month of the period of sixty consecutive months of current or prior membership;

(i) for a member who is a Non-OPP Constable who terminated from the Plan on or after July 1, 2025], the average of the member's annual salary rate in each month of the period of thirty-six consecutive months of current or prior membership;

(j) (for a member who is a Non-OPP Civilian who terminated from the Plan on or after July 1, 2025], the average of the member's annual salary rate in each month of the period of forty-eight consecutive months of current or prior membership.

Section 1 is further amended by adding the following definitions of: Non-OPP Civilian” and “Non-OPP Constable” immediately following the definition of “Minister”:

“Non-OPP Civilian” means a member designated as such by the Minister;”

“Non-OPP Constable” means a member designated as such by the Minister;”

Section 6 is amended by deleting subsections (1) to (1.19) and replacing them with the following:

6. (1) Subject to subsections (2), (3), (4), (5), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26), (32), and (35), every member shall contribute to the Fund during each pay period from the salary paid to the member,

(a) 7.4 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and

(b) 10.5 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(2) Beginning with the first full pay period commencing after July 1, 2025, and subject to subsections (3), (4), (5), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26), (32), and (35), every member shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 7.85 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.0 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(3) Beginning with the first full pay period commencing after October 1, 2025, and subject to subsections (4), (5), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26), (32), and (35), every member shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.3 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.5 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(4) Beginning with the first full pay period commencing after April 1, 2026, and subject to subsections (5), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (18), (19), (20), (21), (22), (23), (24), (25), (26), (32), and (35), every member shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.7 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.0 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Ontario provincial police uniform bargaining unit and commissioned officers below the rank of deputy commissioner

(5) Subject to subsections (6), (7), (8), (32), and (35), a member who is employed as a police officer in the Ontario Provincial Police in the uniform bargaining unit and represented by the Ontario Provincial Police Association, or as a commissioned officer below the rank of deputy commissioner and represented by the Commissioned Officers' Association, shall contribute to the Fund during each pay period from the salary paid to the member,

(a) 8.2 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and

(b) 11.3 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(6) Beginning with the full first pay period commencing after July 1, 2025, and subject to subsections (7), (8), (32), and (35), a member who is employed as a police officer in the Ontario Provincial Police in the uniform bargaining unit and represented by the Ontario Provincial Police Association, or as a commissioned officer below the rank of deputy commissioner and represented by the Commissioned Officers' Association, shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.5 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.7 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(7) Beginning with the full first pay period commencing after October 1, 2025, and subject to subsections (8), (32), and (35), a member who is employed as a police officer in the Ontario Provincial Police in the uniform bargaining unit and represented by the Ontario Provincial Police Association, or as a commissioned officer below the rank of deputy commissioner and represented by the Commissioned Officers' Association, shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.8 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.1 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(8) Beginning with the full first pay period commencing after April 1, 2026, and subject to subsections (32), and (35), a member who is employed as a police officer in the Ontario Provincial Police in the uniform bargaining unit and represented by the Ontario Provincial Police Association, or as a commissioned officer below the rank of deputy commissioner and represented by the Commissioned Officers' Association, shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 9.1 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.4 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Ontario provincial police civilian bargaining unit

(9) Subject to subsections (10), (11), (12), (13), (32) and (35), a member who is employed in the civilian bargaining unit represented by the Ontario Provincial Police Association shall contribute to the Fund during each pay period from the salary paid to the member,

(a) 8.545 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and

(b) 11.645 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(10) Beginning with the full first pay period commencing after July 1, 2025, and subject to subsections (11), (12), (13), (32) and (35), a member who is employed in the Ontario Provincial Police in the civilian bargaining unit and represented by the Ontario Provincial Police Association shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.92 per cent of the amount of salary that does not exceed the Year’s Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.1 per cent of the amount of salary in excess of the Year’s Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(11) Beginning with the full first pay period commencing after October 1, 2025, and subject to subsections (12), (13), (32) and (35), a member who is employed in the Ontario Provincial Police in the civilian bargaining unit and represented by the Ontario Provincial Police Association shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 9.3 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.55 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(12) Beginning with the full first pay period commencing after April 1, 2026, and subject to subsections (13), (32) and (35), a member who is employed in the Ontario Provincial Police in the civilian bargaining unit and represented by the Ontario Provincial Police Association shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 9.65 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.95 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(13) Beginning with the full first pay period commencing after January 1, 2028, and subject to subsections (32) and (35), a member who is employed in the Ontario Provincial Police in the civilian bargaining unit and represented by the Ontario Provincial Police Association shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 9.3 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.6 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Ontario provincial police commissioner and deputy commissioner

(14) Subject to subsections (15), (16), (17), (32) and (35), a member who is the Commissioner of the Ontario Provincial Police, or a police officer with the rank of deputy commissioner in the Ontario Provincial Police shall contribute to the Fund during each pay period from the salary paid to the member,

(a) 8.2 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and

(b) 11.3 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(15) Beginning with the full first pay period commencing after July 1, 2025, and subject to subsections (16), (17), (32) and (35), a member who is the Commissioner of the Ontario Provincial Police, or a police officer with the rank of deputy commissioner in the Ontario Provincial Police shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.5 per cent of the amount of salary that does not exceed the Year’s Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.7 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(16) Beginning with the full first pay period commencing after October 1, 2025, and subject to subsections (17), (32) and (35), a member who is the Commissioner of the Ontario Provincial Police, or a police officer with the rank of deputy commissioner in the Ontario Provincial Police shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.8 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.1 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(17) Beginning with the full first pay period commencing after April 1, 2026, and subject to subsections (32) and (35), a member who is the Commissioner of the Ontario Provincial Police, or a police officer with the rank of deputy commissioner in the Ontario Provincial Police shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 9.1 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 12.4 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Non-OPP Constables

(18) Subject to subsections (19), (20), (21), (32) and (35), a member who is a Non-OPP Constable shall contribute to the Fund during each pay period from the salary paid to the member,

(a) 7.4 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and

(b) 10.5 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(19) Beginning with the first full pay period commencing after July 1, 2025, and subject to subsections (20), (21), (32) and (35), every member who is a Non-OPP Constable shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 7.7 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 10.9 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(20) Beginning with the first full pay period commencing after October 1, 2025, and subject to subsections (21), (32) and (35), every member who is a Non-OPP Constable shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.0 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.3 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(21) Beginning with the first full pay period commencing after April 1, 2026, and subject to subsections (32) and (35), every member who is a Non-OPP Constable shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.3 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.6 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Non-OPP Civilians

(22) Subject to subsections (23), (24), (25), (32) and (35), a member who is a Non-OPP Civilian shall contribute to the Fund during each pay period from the salary paid to the member,

(a) 7.4 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and

(b) 10.5 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(23) Beginning with the first full pay period commencing after July 1, 2025, and subject to subsections (24), (25), (32) and (35), every member who is a Non-OPP Civilian shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 7.775 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 10.955 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(24) Beginning with the first full pay period commencing after October 1, 2025, and subject to subsections (25), (32) and (35), every member who is a Non-OPP Civilian shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.155 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.405 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

(25) Beginning with the first full pay period commencing after April 1, 2026, and subject to subsections (32) and (35), every member who is a Non-OPP Civilian shall contribute to the Fund during each pay period from the salary paid to the member,

  1. 8.505 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 11.805 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Exclusion of justices of the peace and associate judges

(26) (a) Subsections (2), (3) and (4) shall not apply to members who are Justices of the Peace unless the employer advises the Board in writing that those subsections are to apply to those members. Upon the Board being so advised by the employer, subsections (2), (3) and (4) shall apply to members who are Justices of the Peace beginning with the first full pay period commencing after the date the Board is so advised by the employer or at such time the employer may determine.

(b) Until such time, if any, that subsections (2), (3) and (4) apply to members who are Justices of the Peace, those members shall continue to contribute to the Fund at the contribution rate set out in subsection 6(1).

(c) Subsections (1), (2), (3) and (4) shall not apply to members who are Associate Judges unless the employer advises the Board in writing that those subsections are to apply to those members. Upon the Board being so advised by the employer, subsections (1), (2), (3) and (4) shall apply to members who are Associate Judges beginning with the first full pay period commencing after the date the Board is so advised by the employer or at such time the employer may determine.

(d) Until such time, if any, that subsections (1), (2), (3) and (4) apply to members who are Associate Judges, those members shall continue to contribute to the Fund during each pay period from the salary paid to the member,

  1. 6.4 per cent of the amount of salary that does not exceed the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan; and
  2. 9.5 per cent of the amount of salary in excess of the Year's Maximum Pensionable Earnings as prescribed by the Canada Pension Plan.

Additional contributionOPP

(27) In addition to the contribution required by subsections (5), (6), (7), (8), (14), (15), (16), and (17), every member employed as a police officer with the Ontario Provincial Police shall contribute to the Fund during each pay period an amount equal to 1.5 per cent of the salary paid to the member.

Additional contribution – nonOPP Constables and non-OPP Civilians

(28) In addition to the contribution required by subsections (19), (20) and (21), every member who is a Non-OPP Constable shall contribute to the Fund during each pay period an amount equal to 2.3 per cent of the salary paid to the member.

(29) In addition to the contribution required by subsections (23), (24) and (25), every member who is a Non-OPP Civilian shall contribute to the Fund during each pay period an amount equal to 1.145 per cent of the salary paid to the member.

Deduction of contributions

(30) The contributions to be made by a member to the Fund shall be deducted from the member's salary by the person who pays the member's salary, and shall be paid to the credit of the Fund within fifteen days from the date the contribution was deducted or within such longer time as the Board authorizes in writing.

Credit for Contributions

(31) A member shall be given credit in the Plan for the time in respect of which contributions to the Fund are made by or on behalf of the member.

When no contribution required

(32) A member may cease to contribute to the Fund on or after attaining sixty-five years of age.

When no contributions permitted

(33) A member who is covered by a waiver under subsections 15(6) or (7) shall cease to contribute to the Fund upon reaching the maximum age for contributors to a pension fund or plan specified under the provisions of the Income Tax Act (Canada) or any regulations under that Act.

Interest

(34) Interest calculated as determined by the Board shall be credited to each member or former member in each year of the Plan on the amount of contributions, including interest previously credited to the member or former member, standing to the member or former member's credit in the Fund.

Limit on Contributions

(35) The following limits apply to contributions deducted from a member’s salary under this Schedule:

(a) the contributions set out and deducted from the member's salary under this section shall not exceed the annual limit set out in the Income Tax Act (Canada) and Regulations, for that calendar year,

(b) where the member accrues credits in the Plan for less than a calendar year, the annual limit referred to under clause (a) shall be adjusted for the period during the year that the member earns credits,

(c) notwithstanding paragraph 6(35)(a), the contributions set out and deducted from the member's salary under this section shall not exceed the contributions calculated based on the maximum benefit salary rate,

(d) paragraph 6(35)(c) does not apply to Case Management Masters,

(e) paragraph 6(35)(c) does not apply to Justices of the Peace unless the Minister advises the Board in writing that paragraph 6(35)(c) is to apply to Justices of the Peace, and

(f) in subsections 8(6.1), 10(5.1), 10.1(8) and 11(3.1) of this Schedule, the phrase “maximum benefit salary rate” shall be deleted and replaced with “maximum contributory salary rate” for:

i. Case Management Masters; and

ii. Justices of the Peace, unless the Minister advises the Board in writing that paragraph 6(35)(c) is to apply to Justices of the Peace

Paragraph 10.1(1)(a) is amended by adding the following as (vi).

(vi) are not Non-OPP Constable or Non-OPP Civilian.

Subsection 6(2), as it read immediately before this Order, is revoked, retroactive to the date that subsection was enacted.

Subsection 13(14) is amended by deleting the references to “11(2), (4.1) or (5), section 36, 36.3, 36.4 or 36.5” and replacing it with “11(2), (4.1) or (5), section 36, 36.3, 36.4, 36.5 or 48”.

Subsection 13(15) is amended by deleting the references to “11(2), (4.1) or (5), 36.3(4) or (5), 36.4(4) or 36.5(4)” wherever it may appear and replacing it with “11(2), (4.1) or (5), 36.3(4) or (5), 36.4(4), 36.5(4) or 48”.

Subsection 13(16) is amended by deleting the references to “11(2), (4.1) or (5), section 36.3(4) or (5), 36.4(4) or 36.5(4)” and replacing it with “11(2), (4.1) or (5), section 36.3(4) or (5), 36.4(4), 36.5(4), or 48”.

Section 15 is amended by adding the following as subsections (4.1, 4.2, and 4.3) and the subsequent subsections shall be renumbered.

Retirement of non-OPP Constables

4.1 Effective July 1, 2025, every member who is a Non-OPP Constable who has at least thirty years of credit in the Plan, who is a Non-OPP Constable on the date he or she ceases to be a member of the Plan, and who ceases to be a member of the Plan pursuant to subsection 3(1)(b), on or after attaining fifty years of age is entitled to a pension computed in accordance with the Plan.

Retirement of non-OPP Civilians

4.2 Effective July 1, 2025, every member who is a Non-OPP Civilian on the date he or she ceases to be a member, and who has credit in the Plan for a period of time that, when added to the member’s age on the date the member ceases to be a member of the Plan pursuant to subsection 3(1)(b) totals at least eighty-five years, is entitled to a pension computed in accordance with the Plan.

Termination of Non-OPP Constable or Civilian - Transition

4.3 Where a member who is a Non-OPP Constable or Non-OPP Civilian on January 29, 2020, who, during the period beginning on January 29, 2020 and ending on [Day before including in plan] either:

i. commenced receipt of a pension immediately after ceasing to be a member of the Plan; or

ii. commenced receipt of a pension immediately after ceasing to be a member of the Plan, and subsequently died,

and who, if such member had ceased to be a member of the Plan on or after [February 1, 2025] would have qualified for the benefits described in Sections 4.1 and 4.2 above, shall have their pension or survivor benefits recalculated as if Sections 4.1 and 4.2 did apply with adjustments made to future pension or other benefit payments.

Subsection 38(1)(b) is amended by deleting the reference to “subsection 6(2)” and replacing it with “subsection 6(27)”.

The Plan is further amended by adding a new section 48 immediately following section 47:

Purchase of credit for prior service – non-OPP Constables and Civilians

  1. (a) On such terms and conditions as are fixed by the Board, a member who is a Non-OPP Constable or a member who is a Non-OPP Civilian who became a member of the Plan on July 1, 2025 and who has a period of employment with their employer prior to July 1, 2025 may purchase credit in the Plan in respect of that period of prior employment if,
    1. the member is an active member of the Plan,
    2. the member contributed during part or all of the period to their employer’s defined contribution pension plan registered under the Income Tax Act (Canada), and
    3. the member transfers the full amount of their benefit in that defined contribution pension plan directly from that plan to the Fund,

(b) The difference between the amount determined by the Board on the recommendation of the actuary to be equal to the actuarial value of the benefits to which the member will become entitled on obtaining the credit of the Plan, determined on the basis of an annual average salary as defined in (a) of the definition of “annual average salary” and without consideration of subsection 15(4.1), and the amount set out in paragraph (iii) set out immediately above, shall be paid by the member.

(c) For clarity, the service credited in this subsection 1 shall include service with a prior non-participating police services employer provided that any pension benefits accrued with that employer was transferred to the defined contribution pension plan of the current employer of the Non-OPP Constable or the Non-OPP Civilian, if applicable.

If the non-participating police services employer, if applicable, did not provide a plan registered under the Income Tax Act (Canada) to the Non-OPP Constable or the Non-OPP Civilian, then service with such prior employer will not be included in the PSPP.

  1. On such terms and conditions as are fixed by the Board, where a member who is a Non-OPP Constable or a member who is a Non-OPP Civilian who became a member of the Plan on July 1, 2025, and who has a period of employment prior to July 1, 2025  with the employer that was their employer immediately before that date, did not contribute to a pension plan registered under the Income Tax Act (Canada) during the period, then provided that, as of July 1, 2025, the member is an active member or has commenced receipt of a pension under the Plan ,
  1. the Crown shall pay into the Fund such amount as determined by the Board to fund the prior period of employment, and
  2. upon receipt of the amount set out in paragraph (a) immediately above, then credit in the Plan shall be provided to the member for that period of employment.
  1. On such terms and conditions as are fixed by the Board, where a member who was either a Non-OPP Constable or a Non-OPP Civilian on January 29, 2020 and who, during the period beginning on January 29, 2020 and ending on June 30, 2025, either:

i. commenced receipt of a pension under the Plan immediately after ceasing to be a member of the Plan: or

ii. commenced receipt of a pension immediately after ceasing to be a member of the Plan, and subsequently died,

shall have credit in the Plan for such period of employment, with a subsequent adjustment to their pension or other benefit payments.

  1. Any costs that may arise as a result of subsections (1), (2), or (3) set out immediately above, or as a result of the additional benefits provided by subsections 15(4.1) or 15(4.2), shall be determined by the Board and funded by the employer.
