
Order in Council 591/2025
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas there is a desire for employees of Anishinabek Police Service, Lac Seul Police Service, Nishnawbe-Aski Police Service, Rama Police Service, Treaty Three Police Service, Tyendinaga Police Service, UCCM Anishinaabe Police Service, and Wikwemikong Tribal Police Service (collectively, the “Employers”, and individually, the “Employer”) who participate in the Public Service Pension Plan set out in Schedule 1, as amended, to the Public Service Pension Act, 1989 (the “PSPP”) to also access post-retirement insured benefits;
And whereas employees employed by an Employer may be designated by the member of the Executive Council to whom the responsibility for the administration of the PSPP is assigned under the Executive Council Act as belonging to the civilian group of employees of an Employer (the “Non-OPP Civilians”) or to the uniform group of employees of an Employer (the “Non-OPP Constables”) for the purposes of the administration of the PSPP;
And whereas the Lieutenant Governor in Council considers it reasonable and appropriate to permit Non-OPP Civilians and Non-OPP Constables who participate in the PSPP to access post-retirement insured benefits on and after July 1, 2025, that are consistent with the post-retirement insured benefits as are from time to time applicable to the relevant counterpart, namely civilian employees of the Ontario Provincial Police (the “OPP”) in the case of Non-OPP Civilians and uniform employees of the OPP, in the case of the Non-OPP Constables, and subject to the eligibility requirements set out in this Order in Council;
Now therefore, pursuant to the prerogative of His Majesty The King in Right of Ontario and the Crown’s natural person powers at common law to provide for post-retirement insured benefits in the discharge of the Government of Ontario’s executive functions and responsibilities:
- Effective July 1, 2025, the following persons are eligible for the post-retirement insured benefits consistent with the post-retirement insured benefits as are from time to time applicable to the relevant counterpart, and subject to the terms and conditions set out herein:
- A Non-OPP Constable who commenced employment with an Employer prior to January 1, 2018, and who commenced receipt of a PSPP pension on or after January 29, 2020.
- A Non-OPP Civilian who commenced employment with an Employer prior to January 1, 2018, who had credit of at least 10 years in the PSPP, and who commenced receipt of a PSPP pension on or after January 29, 2020.
- On condition of paying fifty per cent (50%) of the premium costs of the benefits, a Non-OPP Constable or a Non-OPP Civilian who commenced receipt of a PSPP pension on or after January 29, 2020, and who:
- commenced employment with an Employer on or after January 1, 2018;
- had credit of at least 20 years in the PSPP;
- qualified for a pension calculated without reference to the PSPP’s early retirement reduction provisions (an “Unreduced Pension”); and,
- commenced receipt of an Unreduced Pension effective the month immediately following the month of termination of active membership in the PSPP.
- On condition of paying one hundred per cent (100%) of the premium costs of the benefits, a Non-OPP Constable or a Non-OPP Civilian who commenced receipt of a PSPP pension on or after January 29, 2020, and who:
- commenced employment with an Employer on or after January 1, 2018; and,
- had credit of at least 20 years in the PSPP.
- For the purpose of determining whether a person is eligible for post-retirement insured benefits under section 1 of this Order in Council on and after July 1, 2025, the periods of credit under the PSPP in respect of employment with a participating employer in the PSPP, or that are purchased or transferred while employed by an Employer, shall be counted.
