Order in Council 643/2025

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Accelerating Access to Justice Act, 2021 (the “Act”), among other amendments, changed the title of a “case management master” to that of an “associate judge”;

And whereas Order in Council 359/2012 refers to “case management master”, “case management masters”, “case management masters’”, “Case Management Masters Remuneration Commission”, and “Masters’ Association of Ontario”;

And whereas it is considered desirable to amend this Order to reflect the updated title in the Act, made subsequent to the making of the Order;

Therefore, Order in Council 359/2012 be amended by:

1. Deleting the definition of “Association” in section 1 and substituting the following in its place:
   “Association” means the Ontario Superior Court Associate Judges’ Association or such other association that may represent associate judges and recognized as such by the Minister;
2. Deleting the definition of “Commission” in section 1 and substituting the following in its place:
   “Commission” means the Associate Judges Remuneration Commission;
3. Deleting the definition of “Minister” in section 1 and substituting the following in its place:
   “Minister” means the President of the Treasury Board or such other member of the Executive Council to whom such powers, duties, functions and responsibilities is assigned or transferred under the Executive Council Act;
4. Striking out “Case Management Masters Remuneration Commission” from section 2 and substituting “Commission”;
5. Striking out “case management masters’ remuneration” from section 2 and substituting “associate judges’ remuneration”; and
6. Striking out “case management master” and “case management masters” wherever they appear in sections 3, 4, 6, 7, 9 and 12 and substituting in each case “associate judge” and “associate judges” respectively.
