Order in Council 855/2026
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas:
- Section 17.15 of the Environmental Assessment Act (the “Act”) provides that the Minister of the Environment, Conservation and Parks (the “Minister”), with the approval of the Lieutenant Governor in Council, may give approval to proceed with a Part II.3 project, give approval to proceed with a Part II.3 project subject to such conditions as the Minister considers necessary, or refuse to give approval to proceed with a Part II.3 project;
- The 1 Port Street East Proposed Marina Project (the “Project”) is deemed to be a Part II.3 project in accordance with section 5 of Ontario Regulation 53/24 under the Act;
- The City of Mississauga (the “Proponent”) submitted an application for approval to proceed with the Project, which includes an environmental assessment for the Project, in accordance with the Act;
- The Ministry of the Environment, Conservation and Parks prepared a review of the environmental assessment for the Project (the “Ministry Review”), gave the notice of completion of the Ministry Review on November 14, 2025, and subsequently received six submissions, none of which requested a hearing;
- Having considered the purpose of the Act, the approved Terms of Reference for the Project, the environmental assessment (including amendments) submitted by the Proponent, the Ministry Review, and the submissions received, the Minister has determined that the Project should be given approval to proceed, subject to the conditions specified in the attached approval;
Therefore, pursuant to section 17.15 of the Act, approval to proceed with the Project is given in the form attached, subject to the conditions specified therein.
