Particulars of a Restraining Order

s. 49 (2) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the issuance of a Restraining Order against a business by the Superintendent of Career Colleges pursuant to s. 46 (2) of the Act.

Contraventions

The Superintendent has ordered Aitchison to stop:

  • Stop advertising the establishment of a career college while not registered contrary to subsection 11 (1) of the Act.
    • Aitchison prepared a website for the purposes of advertising Aitchison: https://aitchisoncollege.com/. That website includes language advertising the establishment of Aitchison as a career college. Aitchison is not registered as a career college.
  • Stop obstructing the inquiries or examinations of the Superintendent or designate of the Superintendent contrary to subsection 38 (10) of the Act;
    • A designate of the Superintendent required the director of Aitchison and an administrator of Aitchison to answer questions in an interview. Aitchison had not provided the availability of either person for the interview.

Required Actions

Aitchison was required to provide by June 30, 2026, written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:

  1. Took all steps necessary to come into compliance with the Act and its regulations including the following:
    1. Stopped advertising the establishment of the Business as a career college while not registered as such;
    2. Confirmed that they will not obstruct the inquiries of the Superintendent or their designates.
  2. Provide to the Superintendent of Career Colleges a written report of compliance, including a description of steps taken by the Business and all documentation necessary to demonstrate that the Business came into compliance with the Act and its regulations.

On June 20, 2026, Aitchison provided the required written confirmation of compliance and detailed actions taken to come into compliance with the Act.
