s. 49 (2) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the issuance of a Restraining Order against an unregistered career college by the Superintendent of Career Colleges pursuant to s. 46 (1) of the Act.

Contraventions
The Superintendent has ordered Randolph School of the Arts o/a Randolph College for the Performing Arts to (stop):
A. Operating a career college contrary to subsection 7(1) of the Act.
Between February 1, 2026, and August 28, 2026 the Business operated a Career College which was not registered with the Superintendent of Career Colleges by offering an unapproved vocational program for a fee of greater than $2,000.00. The program in question was the Performing Arts Program which has a duration of 101 weeks, and was offered for total fees of $13,710.00 per academic year.
B. Offering or providing unapproved vocational programs contrary to subsection 8(1) of the Act.
Between February 1, 2026, and August 28, 2026, the Business offered unapproved vocational programs for a fee. The program in question was the Performing Arts Program which has a duration of 101 weeks, and was offered for total fees of $13,710.00 per academic year.
C. Charging a fee for vocational programs contrary to subsection 9(1) of the Act.
Between February 1, 2026, and August 28, 2026. the Business collected tuition fees for unapproved vocational programs. The program in question was the Performing Arts Program which has a duration of 101 weeks, and was offered for total fees of $13,710.00 per academic year.
D. Advertising unapproved vocational programs contrary to subsection 11 (2) of the Act
Between February 1, 2026 and August 28, 2026 the Business advertised an unapproved vocational program which was offered for a fee. The program in question was the Performing Arts Program which was offered for total fees of $13,710.00 per academic year.
Required Actions
By September 8, 2026, Randolph School of the Arts o/a Randolph College for the Performing Arts is required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:
A. Immediately cease operating a career college.
The Business must immediately cease all activities that constitute operating a career college, including recruiting or enrolling students in vocational programs, delivering or offering vocational programs and charging or collecting tuition or other fees in respect of vocational programs. Nothing in this Order prevents the Business from carrying on lawful activities that do not constitute operating a career college within the meaning of the Ontario Career Colleges Act, 2005.
B. Immediately cease offering and providing all unapproved vocational programs.
The Business must immediately cease offering, promoting, delivering, or providing any vocational program that has not been approved in accordance with the Ontario Career Colleges Act, 2005.
The business shall immediately provide the Ministry of Colleges, Universities, Research Excellence and Security with a complete list of all students who have paid in full or in part, for vocational training in any program, which was not fully delivered by the Business as of February 1, 2026
The Business is responsible for refunding all students who, after January 31, 2026, have paid the Business in full or in part, for vocational training in any program.
C. Immediately cease charging fees for vocational programs.
No fees of any kind shall be charged by the Business to prospective students for vocational training.
D. Immediately discontinue all advertising of unapproved vocational programs.
The Business must immediately remove, discontinue, and cease all advertising and promotional materials relating to unapproved vocational programs. This applies to all forms of advertising, whether digital or physical, including websites, social media platforms, online course listings, brochures, signage, and any previously published content that remains accessible to the public.
The Business shall Provide to the Superintendent of Career Colleges a written report of compliance, including a description of steps taken by the Business and all documentation necessary to demonstrate that the Business came into compliance with the Act and its regulations.
