Overview

The Ministry of Children, Community and Social Services (‘the ministry’) collects personal information from individuals who are required to submit police record checks, offence declarations, notices of charges or convictions, and written statements of relevance pursuant to:

This notice provides details about the authority of the ministry to collect the information and how the ministry handles the information pursuant to requirements of the relevant regulations and legislation.

Authority

The ministry has the authority to collect the personal information in police record checks under subsection 283 (1) of CYFSA, sections 120 and 121 of O. Reg. 155/18, and subsection 38 (2) of FIPPA for the purposes of determining compliance with CYFSA and regulations thereunder.

The ministry also has the authority to collect personal information in police record checks under sections 17 and 18 of O. Reg. 200/99 and subsection 38 (2) of FIPPA for the purposes of determining compliance with IAA and regulations thereunder.

The ministry has the authority to collect the personal information in offence declarations, notices of charges or convictions, and statements of relevance under subsection 283 (1) of CYFSA, sections 126, 128, and 129 of O. Reg. 155/18, and subsection 38 (2) of FIPPA for the purposes of determining compliance with CYFSA and regulations thereunder.

The ministry also has the authority to collect personal information in offence declarations, notices of charges or convictions, and statements of relevance under sections 22, 24 and 25 of O. Reg. 200/99, and subsection 38 (2) of FIPPA, for the purposes of determining compliance with IAA and regulations thereunder.

Access to the collected personal information

Access to the information collected under this notice is limited to persons authorized under the law, including for the purposes of reviewing to assess for compliance with applicable laws. The ministry is also bound by privacy protection rules under FIPPA and takes all necessary steps to safeguard the personal information the ministry collects.

Privacy controls have been established to strictly limit access to police record check documents to those staff, including the delegated Directors, who require access for their responsibilities under CYFSA and IAA and related regulations. These documents will be retained and disposed of in accordance with applicable ministry policies and legislation, including CYFSA, IAA and FIPPA.

Recipient documents

As a recipient of police record checks the ministry has developed policies and procedures in accordance with section 127 of O. Reg. 155/18 under CYFSA and section 23 of O. Reg. 200/99 under IAA. These policies and procedures are available to any person required to provide a police record check to the ministry. Copies can be requested by contacting your regional licensing inspector or by writing to the ministry through the addresses listed in this notice.
