Order in Council

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

O.C. 1597/2024

Whereas subsection 2(2) of the Executive Council Act provides that the Lieutenant Governor may by order in council prescribe the duties of the ministers of the Crown and the duties of any ministries over which they preside;

And whereas subsection 5(1) of the Executive Council Act provides that any of the powers and duties that have been assigned by law to any minister of the Crown may from time to time by order in council be assigned and transferred for a limited period or otherwise to any other minister by name or otherwise;

And whereas subsection 8(1) of the Executive Council Act provides that the authority of the Lieutenant Governor under this Act to prescribe duties of a minister of the Crown or to assign and transfer powers and duties that have been assigned by law to a minister of the Crown to any other minister includes authority, by order in council, to assign responsibility for the administration of an Act or a part of an Act to a minister of the Crown;

Therefore, pursuant to subsections 2(2), 5(1) and 8(1) of the Executive Council Act, despite any provision of a statute or Order in Council:

The administration of each statute listed in Column 2 of Schedule 1 to this Order is hereby assigned to the Minister listed opposite that statute in Column 3 of the Schedule;

And that the appendix to each Order in Council cited in Column 4 of Schedule 1 is hereby revised by adding to it the statute listed opposite the cited Order in Column 2 of the Schedule;

Notice of Proposed Regulation

Personal Health Information Protection Act, 2004

The Minister of Health on behalf of the Government of Ontario invites public comments on a regulation proposed to be made under the Personal Health Information Protection Act, 2004 (“PHIPA”).

PHIPA came into force on November 1, 2004. Ontario Regulation 329/04, (General), made under PHIPA (“the PHIPA Regulation”) also came into force on November 1, 2004. The Government is proposing amendments to the PHIPA Regulation. PHIPA requires that the Minister publish a notice of the proposed amending regulation and allow 60 days for public comment, after which the Minister reports to the Lieutenant Governor in Council, who may then finalize the regulation with or without changes.

Content of Proposed Regulation

The Ministry of Health (MOH) is currently planning for the potential voluntary integration of CritiCall Ontario (CritiCall) into Ornge. In order to begin operating the Critical Care Information System (CCIS), Ornge has to replace Hamilton Health Sciences Corporation as the PHIPA prescribed person in respect of the CCIS.

The PHIPA Regulation currently identifies “Hamilton Health Sciences Corporation” as the prescribed person in respect of the Critical Care Information System under section 13 of the PHIPA Regulation.

The proposed regulation would make the following amendments to the PHIPA Regulation:

  1. Name Ornge as the “Prescribed Person” (i.e., a Prescribed Registry) in respect of the Critical Care Information System (CCIS), replacing Hamilton Health Sciences Corporation.
  2. Name change to replace “Ontario Air Ambulance Services Corporation” with “Ornge” under section 3 (5).

Invitation to Provide Comments on Proposed Regulation

The public is invited to provide written comments on the proposed regulation over a 60-day period, commencing on December 21, 2024, ending on February 18, 2025.

In providing comments, please consider whether the proposed amendments to the PHIPA Regulation should be made, with or without changes. Furthermore, please consider whether any other amendments should be made to the PHIPA Regulation. Please be as specific as possible and provide a full rationale for any suggested changes or additions.
