Minister’s Order

WHEREAS subsection 8(5.1) of the Safety and Consumer Statutes Administration Act, 1996 (the “SCSAA”) provides that the Minister of Public and Business Service Delivery and Procurement (the “Minister”) may, by order, increase or decrease the number of members of the board of directors (the “Board”) of an administrative authority;

AND WHEREAS the Real Estate Council of Ontario (“RECO”) is designated as the administrative authority for the purpose of administering the provisions of the Trust in Real Estate Services Act, 2002 and the regulations made under that Act;

AND WHEREAS RECO is required to exercise its powers and perform its duties to protect, enhance and improve consumer protection and to comply with the principles of maintaining a fair, safe and informed marketplace and promoting the protection of the public interest;

AND WHEREAS RECO’s by-law and articles stipulate that the Board shall consist of nine directors; 

AND WHEREAS, pursuant to a Minister’s Order issued under subsection 5.1(1) of the SCSAA on November 28, 2025, Jean Lépine has been appointed as the administrator for RECO (the “Administrator”) and has the exclusive right to exercise all the powers and perform all the duties of the Board, officers, and members of RECO;

AND WHEREAS, pursuant to subsection 5.2(1) of the SCSAA, on the appointment of the Administrator, the members of the Board ceased to hold office;

AND WHEREAS it is intended that the governance of RECO transition from the Administrator to a re-established Board in two phases, with the first phase as follows;

NOW THEREFORE pursuant to subsection 8(5.1) of the SCSAA, I hereby make the following Order:

  1. The number of members of the Board shall be decreased from nine to five.
  2. RECO shall take the necessary steps to implement this Order no later than December 1, 2026.
  3. This Order revokes and replaces the previous Order respecting RECO made under subsection 8(5.1) of the SCSAA on January 2, 2024.
  4. This Order comes into effect on the day it is made.
