Minister’s Order

WHEREAS subsection 13.3(1) of the Safety and Consumer Statutes Administration Act, 1996 (the “SCSAA”) provides that the Minister of Public and Business Service Delivery and Procurement (the “Minister”) may, by order, require a designated administrative authority to establish one or more advisory councils and include, as members of an advisory council, representatives of the public, consumer groups, businesses, or government organizations and other persons as the Minister determines;

AND WHEREAS the Real Estate Council of Ontario (“RECO”) is designated as the administrative authority for the purpose of administering the provisions of the Trust in Real Estate Services Act, 2002 (the “TRESA”) and the regulations made under that Act;

AND WHEREAS RECO is required to exercise its powers and perform its duties to protect, enhance and improve consumer protection and to comply with the principles of maintaining a fair, safe, and informed marketplace and promoting the protection of the public interest;

AND WHEREAS an order requiring an advisory council to be established provides a forum to enable RECO to obtain advice and input from key stakeholders to make informed decisions related to its consumer protection mandate and its regulation of real estate salespersons, brokers and brokerages;

AND WHEREAS it is intended that the governance of RECO transition from the administrator appointed by Minister’s Order issued under subsection 5.1(1) of the SCSAA on November 28, 2025, to a re-established board of directors at RECO (the “Board”);

NOW THEREFORE pursuant to subsection 13.3(1) of the SCSAA I hereby make the following Order:

  1. In this Order,
    “broker,” “salesperson,” “brokerage” and “registrant” have the same meanings as in the TRESA.
  2. RECO shall establish an advisory council to represent the perspectives of registrants. The advisory council shall include members who are directors, officers, employees, members or agents of industry associations representing the interests of registrants. In addition, the advisory council may include members from any of the following classes of persons:
    1. brokers.
    2. salespersons.
    3. individuals who are directors, officers, employees or agents of registered brokerages.
  3. RECO shall take the necessary steps to implement this Order no later than January 1, 2027.
  4. This Order revokes and replaces the previous Order respecting RECO made under subsection 13.3(1) of the SCSAA on January 2, 2024.
  5. This Order comes into effect on December 1, 2026, or the day the members of the Board hold office, whichever is earlier.
