Minister’s Order
WHEREAS subsection 8(5) of the Safety and Consumer Statutes Administration Act, 1996 (the “SCSAA”) provides that the Minister of Public and Business Service Delivery and Procurement (the “Minister”) may, by order, provide that no more than a fixed percentage of members of the board of directors (the “Board”) of an administrative authority shall be drawn from among the persons or classes of persons specified in the order;
AND WHEREAS the Real Estate Council of Ontario (“RECO”) is designated as the administrative authority for the purpose of administering the provisions of the Trust in Real Estate Services Act, 2002 (the “TRESA”) and the regulations made under that Act;
AND WHEREAS RECO is required to exercise its powers and perform its duties to protect, enhance and improve consumer protection and to comply with the principles of maintaining a fair, safe, and informed marketplace and promoting the protection of the public interest;
AND WHEREAS an order limiting the percentage of members of RECO’s Board that may be drawn from certain persons or classes of persons facilitates a Board that effectively oversees real estate salespersons, brokers, and brokerages and protects consumers;
AND WHEREAS it is intended that the governance of RECO transition from the administrator appointed by Minister’s Order issued under subsection 5.1(1) of the SCSAA on November 28, 2025, to a re-established Board at RECO;
NOW THEREFORE pursuant to subsection 8(5) of the SCSAA, I hereby make the following Order:
- In this Order,
“broker”, “brokerage”, “registrant”, and “salesperson” have the same meanings as in the TRESA. - No more than zero per cent of the elected members of the Board shall be drawn from among any of the following classes of persons:
- Registered brokers or salespersons.
- Individuals who are directors, officers, employees, members or agents of registered brokerages.
- Individuals who are directors, officers, employees, members or agents of an industry association representing the interests of registrants.
- Individuals who within the one-year period before becoming a member of the Board met the description in any of clauses 2(a) through (c).
- For greater certainty, paragraph 2 of this Order does not apply in relation to members of the Board appointed by the Minister, who may be representatives of consumer groups, business, government organizations, or such other interests as the Minister determines pursuant to subsection 8(2) of the SCSAA.
- RECO shall take the necessary steps to implement this Order no later than December 1, 2026.
- This Order revokes and replaces the previous Order respecting RECO made under subsection 8(5) of the SCSAA on January 2, 2024.
- This Order comes into effect on the day it is made.
