Particulars of a Restraining Order

Section. 49 (2) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the issuance of a Restraining Order against a corporation that at the time of service was a registered career college by the Superintendent of Career Colleges pursuant to s. 46 (1) of the Act.

Contraventions

The Superintendent has ordered Native Education and Training College (NETC) to stop:

A. Offering or providing unapproved vocational programs contrary to subsection 8 (1) of the Act.

  • Review of the NETC's website, together with information from the NETC's student files and a student complainant, identifies that NETC offered and provided vocational programs, which it has not been approved to deliver by the Superintendent.

B. Charging or collecting fees in relation to unapproved vocational programs contrary to subsection 9 (1) of the Act.

  • Review of the NETC's website, together with information from the NETC's student files and a student complainant, identifies that NETC charged and collected fees in relation to vocational programs, which it has not been approved to deliver by the Superintendent.

C. Advertising the provision of unapproved vocational programs contrary to subsection 11 (2) of the Act.

  • Review of the NETC's website, together with information from the NETC's student files and a student complainant, identifies that NETC advertised the provision of vocational programs, which it has not been approved to deliver by the Superintendent.

Required actions

By September 12, 2024, NETC was required by the Superintendent to provide written confirmation signed by a person with authority to bind the corporation, together with all available supporting evidence, confirming that they:

A. Take all steps necessary to come into compliance with the Act and its regulations including the following:

  • stop offering the provision of unapproved vocational programs
  • stop providing unapproved vocational programs
  • stop advertising the provision of unapproved vocational programs 
  • stop charging fees in relation to unapproved vocational programs

B. Provide to the Superintendent of Career Colleges a written report of compliance, including a description of steps taken by the Registrant and all documentation necessary to demonstrate that the Registrant came into compliance with the Act and its regulations.
