Approval of the Victoria County Landfill Environmental Assessment
The ministry’s approval of the environmental assessment for an expansion of the Lindsay-Ops Landfill in the County of Victoria.

Reasons
My reasons for giving approval are:
- On the basis of the proponent’s Terms of Reference, Environmental Assessment and the Review, the proponent’s conclusion that, on balance, the advantages of this undertaking outweigh its disadvantages appears to be valid.
- No other beneficial alternative method of implementing the undertaking was identified.
- On the basis of the proponent’s Terms of Reference, Environmental Assessment, the Review and the conditions of approval, the construction, operation and maintenance of the undertaking will be consistent with the purpose of the Act (section 2).
- The Government Review Team has indicated no outstanding concerns that cannot be addressed through conditions of approval. The public review of the Environmental Assessment did not identify any outstanding concerns which can not be addressed through these conditions of approval or conditions of a Provisional Certificate of Approval.
- The submissions received after the Notice of Completion of the Review was published are being dealt with through conditions where appropriate. I am not aware of any outstanding issues with respect to this undertaking which suggest that a hearing should be required.
Conditions
1. Definitions
- Proponent
- means The Corporation of the County of Victoria;
- site
- refers to the site located about 1 kilometre north of Lindsay on Part Lots 25, 26, and 27, Concession 6, in the Township of Ops;
- MOE
- refers to the Ministry of the Environment; and,
- Regional Director
- refers to the Director of the MOE's eastern Region.
2. General requirements
- The Proponent shall comply with the provisions of the Environmental Assessment all of which are incorporated herein by reference except as provided in these conditions and except as provided in any Part V, Environmental Protection Act (EPA), Provisional Certificate of Approval for the site, and in any other approvals or permits that may be issued.
- These conditions do not prevent more restrictive conditions being imposed under other statutes.
- Where a document is required for the Public Record, it shall be provided to the Director of the Environmental Assessment and Approvals Branch, MOE, for filing with the public record maintained for this undertaking. Additional copies of such documents will be provided by the proponent for public access to:
- the Regional Director;
- the Clerk’s office of the proponent; and
- public libraries within the community.
3. Conditions of approval
- This approval applies to the preferred design option 1, the expansion of the landfill to the north without landfill mining, as set out in the Environmental Assessment.
- When submitting an application for approval under Part V of the EPA, the Proponent shall include a proposal for establishing a public liaison committee which shall be established in the event that significant changes in the conceptual design of the landfill or related mitigation measures are proposed, based on Environmental Protection Act investigations. The proposal may provide for the committee to be established at an earlier date and may provide for its termination or suspension in the event there is not a continuing need for it.
- The Proponent shall implement the six recommendations of the Jacques Whitford Environmental Limited Report, titled
Proposed Use and Expansion of the Lindsay-Ops Landfill Site – Bird Hazard Study
dated November 10, 1998. A report prepared by the Proponent describing the implementation of the recommendations shall be submitted with application for approval under the EPA Part V, and shall be placed in the public record.
