Designation

The Environmental Assessment Act (Act) allows for a project to be designated, by regulation, as a project to which the Act applies.

Between March and May 2024, the ministry sought feedback from the public on a proposal to make a regulation that would designate York1’s proposed waste management project as a Part II.3 project under the Act and make it subject to comprehensive environmental assessment requirements. All comments received were carefully considered before a decision was made.  The regulation, O. Reg. 284/24, was made on June 28, 2024.

Exemption

Between April and May 2025, we collected feedback from the public on a proposal to remove environmental assessment requirements for the project.

As part of the Protect Ontario by Unleashing Our Economy Act, 2025, we revoked the designating regulation, O. Reg. 284/24, and amended the Environmental Assessment Act (see section 17.28.1).

This exempts the project from environmental assessment requirements.
