Flow Chart 1 - Determining when a PSR is required

Does the workplace meet the definition of a "factory" under the OHSA?

  • If no, a PSR is not required.
  • If yes, continue.

Is it a logging operation?

  • If yes, a PSR is not required.
  • If no, continue.

Will one or more circumstances in the section 7 table exist and a corresponding applicable provision of the Industrial Establishments Regulation listed in the section 7 table apply?

  • If no, a PSR is not required.
  • If yes, continue.

Is the apparatus, structure or protective element or process new or newly installed in the workplace?

Does the apparatus, structure or protective element or process already exist and are modifications planned?

  • If no, a PSR is not required.
  • If yes, continue.

Are the modifications such that new or modified engineering controls or other new or modified measures would be required to comply with the applicable provisions?

  • If no, a PSR is not required.
  • If yes, continue.

Does an exemption set out in the section 7 Table apply? Refer to Flow Charts 2, 3, 4, 5, and 6.

  • If no, a PSR is required.
  • If yes, continue.

Are the documents to establish the exemption available?

  • If yes, a PSR is not required.
  • If no, a PSR is required.

Flow Chart 2 – Flammable liquids storage exemption

Are 235 litres or less of flammable liquids located in a building or room

  • If yes, a PSR is not required.
  • If no , continue.

Are adequate cabinets being used to store the flammable liquids?

Will the cabinets in use be replaced with adequate cabinets to store the of flammable liquids?

  • If no, a PSR is required.
  • If yes, continue.

Is the total quantity of flammable liquids stored in each adequate cabinet 235 litres or less?

Will the quantity be reduced to  235 litres or less in each adequate cabinet?

  • If no, a PSR is required.
  • If yes, continue.

Are there three or fewer cabinets containing flammable liquids in the workplace?

Will the cabinets be arranged in groups of 3 or less and with a minimum distance of 30 metres between groups?

  • If no, a PSR is required.
  • If yes, continue.

Are the documents to claim an exemption available?

  • If yes, a PSR is not required.
  • If no, a PSR is required.

Flow Chart 3 – Item 2 guarding exemption

Are either of the following used as a protective element in connection with an apparatus?

  • a safeguarding device that signals the apparatus to stop
  • a barrier guard that uses an interlocking mechanical or electrical safeguarding device

If no, a PSR is not required.

If yes, was the apparatus manufactured in accordance with and does it meet current applicable standards, or has it been modified to meet them?

  • If no, a PSR is required.
  • If yes, continue.

Was the apparatus installed in accordance with current applicable standards, if any, and the manufacturer’s instructions?

  • If no, a PSR is required.
  • If yes, continue.

Was the protective element manufactured in accordance with current applicable standards, does it meet them or has it been modified to meet them?

  • If no, a PSR is required.
  • If yes, continue.

Was the protective element installed at the time that the apparatus was manufactured?

Was the protective element installed in accordance with current applicable standards, if any, and the manufacturer’s instructions?

  • If no, a PSR is required.
  • If yes, continue.

Are the documents to claim an exemption available?

  • If yes, a PSR is not required.
  • If no, a PSR is required.

Flow Chart 4 – Racks and stacking structures exemption

 Are material, articles or things placed or stored on a structure that is a rack or stacking structure?

  • If no, a PSR is not required.
  • If yes, continue.

Is the rack or stacking structure designed and tested for use in accordance with ANSI MH16.1-2012(R2019)?

  • If no, a PSR is required.
  • If yes, continue.

Are modifications being made which will change the configuration (for example, moving location of cross beams, installing wider uprights) of the rack or stacking structure?

  • If yes, a PSR is required.
  • If no, continue.

Are the documents to claim an exemption available?

  • If yes, a PSR is not required.
  • If no, a PSR is required.

Flow Chart 5 – Spray booth exemption

Is the process conducted inside a spray booth that is manufactured and installed in accordance with current applicable standards?

  • If no, a PSR is required.
  • If yes, continue.

Does the spray booth meet the definition of a spray booth in the Ontario Fire Code?

  • If no, a PSR is required.
  • If yes, continue.

Are the documents to claim an exemption available?

  • If yes, a PSR is not required.
  • If no, a PSR is required.

Flow Chart 6 – Lifting devices exemption

Is a vehicle lift or hoist used?

If no, go to the question about other lifting devices. If yes, is the vehicle lift or hoist certified to meet current applicable standards?

Are any of the following used:

  • a travelling crane
  • overhead crane
  • monorail crane
  • gantry crane
  • jib crane
  • other lifting device suspended from or supported by a structure in a factory

If no, a PSR is not required.

If yes, continue.

Is the supporting structure originally designed for the lifting device?

  • If no, a PSR is required.
  • If yes, continue.

Are the documents to claim an exemption available?

  • If yes, a PSR is not required.
  • If no, a PSR is required.
